Welcome to TENWAYS! Thank you for deciding to become a member of the TENWAYS Affiliate Program.

The following terms and conditions apply to anyone accessing or using the Program, whether as a merchant ("we", "TENWAYS" or "merchant") or as an affiliate ("you" or "affiliate") who refers customers to use the merchant's product or service.

By joining the Program, affiliates accept to use the Program in the manner stated in these Terms and Conditions and are bound by them. You are not authorized to register as an affiliate or participate in the Program in any way if you do not agree to these Terms and Conditions in their entirety.

1. Approval or Rejection of the Application

We reserve the right to approve or reject ANY Affiliate Program Application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

2. Commissions

For a sale to generate a commission for an Affiliate, the customer must complete the order form and remit full payment for the product. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. The commission amount is determined by the order value and does not include any additional fees (tax, shipping cost, etc.). Properly coded links are the sole responsibility of the affiliate. Commissions can be viewed on the Affiliate Dashboard.

Commissions will be paid every 45 days. For an Affiliate to receive a commission, the referred account must remain active for a minimum of 30 days.

Payments will generally be paid out via PayPal. Please remember to add your PayPal when you sign up.

Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

3. Termination

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

In addition to the foregoing, we reserve the right to terminate any Affiliate account at any time, for any violations of this Agreement or for no reason.

If the Affiliate terminates the agreement, no further commissions from us will be paid for any past or future customer transactions.

4. Usage and Obligations

Affiliates are permitted to use the TENWAYS brand and marketing resources available in the Affiliates section of the TENWAYS application. Logos and other assets cannot be modified.

The Affiliate does not gain any trademark, copyright, or any other rights to these materials.

The Affiliate will never imply that they are acting on behalf of TENWAYS and will never advertise TENWAYS products directly. The Affiliate will never bid for advertisements that compete with TENWAYS during the contract term.

The Affiliate will never represent themselves, TENWAYS, or their relationship with TENWAYS in a false or misleading way.

The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing TENWAYS.

5. Referral Links

Do not forget to add your referral link to your website, newsletter, or any other social media sites. It’s important for conversion attribution.

Copy and paste the referral link from your Assets page onto your website, newsletter, or any other social media sites. Your unique publisher ID is incorporated into the referral link which helps to track the conversion from the customer you brought in.

You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in Condition 4.

TENWAYS Affiliate Program will provide the Affiliate with specific Referral Links to link advertisements and other marketing content to https://www.tenways.com. TENWAYS Affiliate Program will track users who have visited these Referral Links using cookies which expire after 30 days. Only users who make a purchase while the cookie is active will be considered referrals of the Affiliate and recorded as such in the Affiliate Dashboard.

The Affiliate is not authorized to modify or alter the Referral Links or the cookies in any way. TENWAYS Affiliate Program is not responsible for any tracking or reporting errors that may result from any modifications to the Referral Link or the cookies.

6. Coupon and Deal Sites

TENWAYS occasionally offers coupons to select affiliates and to our newsletter subscribers. If you’re not pre-approved/ assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:

Affiliates may not use misleading text on affiliate links, buttons, or images to imply that anything besides currently authorized deals to the specific affiliate.

Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific saving by clicking on a clearly marked link, button, or image for that particular coupon or deal. Your link must send the visitor to the merchant site.

Users must be able to see coupon/ deal/ savings information and details before an affiliate cookie is set (i.e. "click here to see coupons and open a window to the merchant's site" is NOT allowed).

Affiliate sites may not have "Click for (or to see) Deal/ Coupon" or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the Program immediately.

7. Non-Pay-Per-Click (PPC) Policy

PPC bidding is NOT allowed without prior written permission.

8. Liability

We track customers who click on your link using cookies, thus, they must be using cookies so we can track them.

We cannot track a user who does not allow cookies or clears their cookies, so we cannot pay rewards for that person's activity.

Cookie duration is specified in the affiliate signup form. When a customer clicks on the affiliate's link or applies the coupon, the tracking day begins. During the cookie period, every purchase made by this client on the merchant's website will result in commissions to the affiliate (the customer must be required to click on the affiliate link on each purchase).

TENWAYS will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/ or to our website(s).

We do not make any expressed or implied warranties with respect to the Program and/ or the memberships or products sold by TENWAYS. We do not claim that the operation of the Program and/ or our website(s) will be error-free and we will not be liable for any interruptions or errors.

9. Term of the Agreement

The term of this Agreement begins upon your acceptance into the Program and will end when your Affiliate account is terminated.

The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement is unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

10. Indemnification

Affiliate shall indemnify and hold harmless TENWAYS and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by TENWAYS to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.

11. Modification

We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include but are not limited to changes in the scope of available commissions, commission schedules, payment procedures, and Affiliate Program rules.

12. Exclusion from Affiliate Program

If an affiliate wants to be dismissed from the affiliate program, they can send an email to: tenways.affiliate@tenways.com.
